Conditions

Any order from the customer, as well as any delivery made by Essentialys Belgium, represented by Pierre GUY & Jean-François TIEMAN, implies the buyer's full and unreserved acceptance of these general conditions of sale to the exclusion of all other documents, such as folders, prospectuses or catalogs issued by the seller, which have only an indicative value. The cancellation or inapplicability of one of the clauses of the general or particular conditions does not involve the cancellation of the other general or particular clauses which remain fully valid and applicable. Any deviation from these general conditions will only have value if it is expressly accepted by Pierre Gui & Jean-François Pieman or one of its representatives.

The customer also declares that he has been fully informed of the characteristics and conditions of use of the services and products he orders.

The information stated by the buyer, when taking the order commits it: in case of error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product. Orders are not final until they have been confirmed by the payment of the full price by the buyer. Any modification or resolution of the order by the buyer cannot be taken into account and the price paid will not be returned. Offers of products and / or gifts are valid while stocks last.

Orders are processed Monday through Friday excluding holidays. Departures are from Belgium within two to eight working days of receipt of your order, subject to available stocks. If you are paying by bank transfer, the delivery times indicated only start counting from the day of receipt of your payment and not from the date of the order. Delivery is made to the address of your choice even if it is different from the billing address. Delivery is ensured for Belgium within the aforementioned deadlines and is generally ensured by us, however, from time to time, we use external services, such as the Post Office, Express Mail etc. For Belgium is already included in the price, a contribution to the shipping costs. It is calculated on a lump sum basis. For other countries, a contribution to the shipping costs (packaging and postage) is added to the order, with exceptions and neighboring countries. These prices are subject to changes in the cost of the price index and can be modified without prior notice. We take no responsibility for the delay of the Post. Exceeding delivery times cannot give rise to damages. Express delivery at short notice is possible (Contact us via 0475 / 76.62.01) Essentialys disclaim all responsibility for the delay in delivery and the failure to deliver in the event of force majeure or an event beyond its control, which makes the execution of the agreement impossible or more expensive in whole or in part, or in the case of third parties, such as the suppliers of the parties hereto, subcontractors, agents and representatives, or else failing to meet the customer's commitments. Are considered as force majeure releasing the seller from its obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied. The seller will keep the buyer informed in a timely manner of the cases or events listed above. If, due to the state of stocks, the products ordered could not be delivered within this time, Essentialys srl will contact with the consumer and the parties will agree on another acceptable delivery time. The ordered products will be delivered to the place of delivery agreed with the buyer. If Essentialys srl has not made the order available to the consumer within the deadlines referred to in the previous paragraph, the consumer has the right to notify Essentialys that they cancel his order. In the event of a valid cancellation by the consumer, Essentialys will reimburse the consumer for all sums paid by the latter in payment for the canceled order,

Payment is made via the secure online payment platform "Paypal" and "Ing epay". You also have the possibility at the end of your order to make a national or international bank transfer with your order number. For Belgium (only)  you can pay in cash or by check on delivery.

Any return of products sold by us must be the subject of a formal agreement between the seller and the buyer. Any return accepted by the seller, in the event of an apparent defect or non-conformity of the products delivered, which will be noted by the seller, will allow the buyer to obtain free replacement or the return of a credit note to his profit, to the exclusion of any other indemnity or damages. A copy of the invoice must accompany your return, as well as a letter indicating the reason for this return. We will exchange or refund within ten working days of receipt. The return costs will also be reimbursed in the event of an error on our part. The essentialys.be shop will be obliged to refuse damaged or already used items.

To exercise the right of evocation, you must inform us, by an unequivocal declaration, of your decision to revoke the contract. You can use a simple dated and signed letter of revocation for this purpose. with regard to the exercise of the right of revocation, the burden of proof lies with the customer. The customer is responsible for any loss of value of the products resulting from handling beyond what is necessary to determine the nature, characteristics and operation. The right of revocation only applies to products accompanied by their accessories, instructions for use, as well as the invoice and proof of purchase. The products which will not be returned to Essentialys srl in this state, will remain available to the customer. The availability period is 1 month, after which Essentialys srl becomes the owner of the product. In case of exercise of the right of revocation, the customer will return the products to Essentialys srl by all means and at their own risk and expense. Shipments with postage paid by the recipient and cash on delivery will be refused. For bulky products, Essentialys srl may, at the explicit request of the customer, remove the articles, for a transport cost of 50 EUR invoiced to the customer. The customer can also return the product to the reception of the Essentialys srl store in Genval. The right of revocation does not apply to the following products: a) Items, damaged or incomplete; b) Items with a very limited shelf life; c) Sealed articles which are not suitable for return for health or hygienic reasons and whose seal is broken after delivery; e) Items which by their nature can no longer be returned; The customer, or a third party other than the carrier and designated by the consumer, must exercise their right of revocation within 14 calendar days from the day following the delivery of the product or physically takes possession of the product, by registered letter, by telephone (02 / 476 06 27), by e-mail (info@essentialys.be) the customer returns the products within 14 calendar days from the exercise of the right to revocation or notification. The customer can also return the product to the reception of the Essentialys srl store in Louvain-La-Neuve at no cost. In the case of a single order but separate deliveries, the period of 14 days starts from the day of physical possession of the last product. In the case of delivery of a product made up of multiple parts, the period starts from the day of the physical possession of the last part of the product. To proceed with the reimbursement, Essentialys srl reserves the right to wait for the product (s) to be received or for the customer to prove that all the products have been returned. In this case, Essentialys srl only accepts proof of the shipment recommended by bpost with the photo of the product and the photo of the postal parcel. The customer will spontaneously communicate, on request, the parcel number to allow it to be searched via bpost. Then, within 14 calendar days after receipt of the products or proof of return, as described above, the total purchase price paid is refunded, via the method of payment used when ordering. No reimbursement is made in cash. Essentialys srl reserves the right at any time to deduct from the purchase price to reimburse the amount of the depreciation for which the customer is responsible. If the customer has expressly requested a delivery method other than the cheapest standard delivery offered by Essentialys srl, the additional delivery costs will not be reimbursed.
